New Delhi
The Supreme Court has said that farmers have the right to operate but the demonstration should be non-binding. The Supreme Court has said it is considering forming an independent and impartial committee, which will include experts as well as government and representatives, who will try to find a way through negotiations. The court said that p. Experts like Sainath can be given a place in the committee. The apex court said that the purpose of the demonstration could be fulfilled only when the representatives of the farmers and the government took the path out of the dialogue. We want to console you by forming a committee for this.

Solicitor General Tushar Mehta: Doubts remain as to whether the validity of the law is to be debated.

Chief Justice S.A. Bobde: We are not yet hearing the validity of agricultural law. We are only talking about the right to perform and the right of those who come.

Applicant’s Advisor Harish Salve: The power of whatever is in Delhi is being affected indirectly and indirectly. The arrival of goods is restricted and prices are rising. For Delhi’s 20 million population, vegetables, fruits, etc. come from the border, which is blocked. Everyone has the fundamental right to demonstrate, but the rights of others should not be affected and need to be balanced. The price that is rising cannot be compensated.

Chief Justice: We want to make it clear that we have recognized the right to protest against the law. But this performance does not affect the lives and rights of others. We cannot revoke the right to do so. Demonstrations may continue but violence should not occur. Police must ensure that they do not use force on non-violent protesters.

Salve: No right is absolute from right to influence to right movement. Demonstration rights but the city cannot be held hostage. Whatever organizations are gathering the crowd, it is their responsibility to take responsibility in case of violence and it should create a body for them. The people of Delhi live in Gargaon, they will not be able to interfere in their right to come. The taxpayer’s property will be burned.

Chief Justice: Farmers have the right to protest. We are talking about how to perform here. We will ask the farmers’ union to choose the option of demonstration so that the rights of others are not affected.

Salve: The protocol of the government should be that the representatives of the people who do it should be identified and held accountable in case of harm.

Chief Justice: But those who come for the demonstration cannot be deposited in advance. The police should also avoid using force. The purpose of the demonstration should also be to lead the way to a conversation. We want to provide the same for that. That is why we are proposing to form an independent and impartial committee, where both parties should put their case. Listen to both parties in the committee and give your vote, which both parties should follow. We also want to hear from the farmers’ union on this matter.

Salve: Chaos is chaos if the performance is just to do.

Chief Justice: We are saying the same thing. Demonstrations should be nonviolent and should be in point. Those who are complex in influence should put forward their own opinion and respond to it on the other hand. And to do the same thing, we want to form a committee, we have an expert p. Wants people like Sainath. During this period, the protests were unprovoked and you (facing the Attorney General of the Government of India) did not in any way create a situation of violence.

Attorney General K.K. Venugopal: But farmers are demanding that the law be withdrawn. They should be asked to speak. That way, the matter will not be made to either withdraw the law or it will not happen.

Chief Justice: We don’t think you will believe that is why we have decided to form a committee. We’ve already seen how successful your conversation is.

Chief Law Officer: There has been a blockage for 22 days. There is tremendous damage. People are unable to go to work. The risk of corona is different. The ambulance is not coming. When these people return to their village after the demonstration, they will spread corona there like wildfire. It cannot be that if the law is not withdrawn it will be frozen indefinitely. They have come up with six months of preparation. Blocking the border in this way cannot be allowed. In the event of a war, it happens that everything is cut off.

Chief Justice: Are all roads leading to Delhi blocked?

Solicitor General: Tikri border and Indus border.

Chief Justice: That is, Delhi is not completely chalk, it seems that Salve has said something big.

Salve: My lord main artery is closed.

Delhi Government Advocate Rahul Mehta: There are 100 arterial pathways, such an argument should be given in writing. The Delhi government should be made the respondent in this petition.

Solicitor General: It is not a political platform and it should not unite against Delhi. Efforts should be made to resolve this issue through dialogue.

Punjab Government Advocate P. Chidambaram: We object to Salve’s application. What else can happen in a democracy? A large number of people disagree with the law and that is why large demonstrations are taking place. Remember what happened in America against the Vietnam War. The farmers have not blocked the border and the road, they want to come to Delhi but the police have stopped them there. As can be seen in the photograph, the police are barricading.

Chief Justice: The court will not decide who comes or not. It is the job of the police to be vigilant if the crowd becomes violent. The police act on the basis of intelligence.

Chidambaram: But it is not a bunch, but a peasant organization. The police themselves are stopping them and blaming the farmers. This issue should be discussed in Parliament.

AP Singh, Advocate, Indian Farmers Union (Bhanu Group): It is an agricultural country, not a multi-national country. In the lockdown, everyone saw that the farmers did not go hungry. The multinational company did not do this.

Kapil Sibal, Arun Jelly Old speech on farmers: How old speeches of Congress-BJP, Sibal and Jaitley on farmers went viral

Chief Justice: The people of Delhi should not go hungry, it is the cause of trouble. You have the right to demonstrate, we are not interfering. You demonstrate, but the goal can only be achieved when the path is negotiated. You can’t sit for years on display. We know the situation of farmers. We are Indians. We have sympathy. We are talking about how to perform.

Salve: In this case the court should order that the police should not allow the lives of the people of the city to be affected.

Chief Justice: The Attorney General should tell you whether the central government guarantees that it will not enforce the law until the court hears.

Chief Law Officer: It’s hard.

Chief Justice:
Can the central government say it will not take executive action under the law to facilitate negotiations?

Chief Law Officer: We will bring notice in this regard.

Solicitor General: But it will be difficult.

Chief Justice: If the attorney general is talking about taking instructions, you shouldn’t say that. We order the respondent farmers union to strike a notice and put the case before the vacation bench.
